Motorcycle Accidents
Attention Motorcycle Accident Victims: Your rights after an accident are different from all other motor vehicle accident victims.
The Florida No-Fault Law (also known as PIP) does not apply to anyone operating, or while a passenger on, a motorcycle. As a result, there is no readily available source of money to pay your medical bills unless you have private health insurance. However, because PIP is not applicable to motorcycle riders, you have the right to seek compensation in court without showing loss of limb, loss of eyesight, scarring or any other permanent injury. Pedestrians and those in cars and trucks must meet those requirements. In real life, you probably will have a permanent injury if you are in an accident on a motorcycle.
At The Martindale Law Group, we seek to maximize the recovery of motorcycle accident victims. For example, many people do not realize that often your automobile policy’s Underinsured Motorist coverage (or the auto policy of a relative in your household) will cover you if you are hit by a car or truck without insurance or without enough insurance. This is the only auto policy coverage that will usually cover you while on a motorcycle. We are here to help you with your claim and we will seek any and all sources of recovery so you and your family can try to put your life back together.
If your loved one is killed in a motorcycle accident, please do not delay in seeking our help. Under Florida’s Wrongful Death Act, the Executor of the Estate has only two years from the date of the accident to file a lawsuit, or recovery is forever barred by the statute of limitations. (Ordinary negligence cases not resulting in death are subject to a four-year statute of limitations.) You must act promptly to protect the interests of the spouse and dependant children of those killed in accidents, whether on a motorcycle, in a car, or while a pedestrian.
We are here to help and make sure your rights and the rights of your loved ones are protected. Please call us for a free evaluation of your motorcycle case. |
